Memo of Settlement

August 1st

Brothers and Sisters;

As you are no doubt aware, the RCTC General Committee signed a tentative agreement on Thursday that will be taken to the RTC membership for a ratification vote. Although this was done a couple of weeks ago and was rejected, we feel that this new settlement addresses their needs on the seniority issue that was the reason for the previous rejection.

The only other change deals with the reinstatement of the Pension consent provision wherein the negotiating committee was directed to obtain a $50,000.00 per year solution if consent is not given by the Company rather than the one-time $200,000.00 benefit under the previous Memo of Settlement. This has been done. The Company has clearly indicated, however, that they do not have any intent of ever paying this sum of money.

I would like to thank each and every brother and sister for their help in ensuring a successful conclusion to this dispute. Although the ratification vote has not been conducted yet, the bargaining committee feel very good about the chances of this settlement being ratified, however, as put forth by a very honorable brother during the last vote,"It isn't over till the fat lady sings, or when they ratify".

I will let you all know the results as soon as they become available.

I would also request that any of you, or your divisions, who had planned on sending donations to the RTC strike fund assistance program, continue to do so as these brothers and sisters will not receive money from the Company for another month even if the contract is ratified.

On behalf of all RTC's, I would like to thank you for your support and say that we are proud to be part of this great
Brotherhood of Locomotive Engineers.
